"If any horse, mule, ass, sheep,, swine, or othe beast or cattle of any kind shall at any time afte this by-law shall come into operation, be foun depasturing, whether under the tendence or con trol of any person or persons or not, in or upo any street or other highway within the limits o the town of Nelson, or. upon the sides of any suc street or highway, and whether such street o highway, or any part thereof, shall lead or pas through or over any common or waste or tmen closed ground or not, the owner of any such horse .mule, ass, sheep, swine, or other Wast or cattle shall, for every breach of this by-law, forfeit an pay a penalty of not: exceeding ten shillings fo the first .offence, and not exceeding forty shilling for the second and every eubsequent.offenco; an in case the owner's name cannot be ascertained o any such animal so depasturing as aforesaid, th same may bd driven to the nearest pound, an shall be subject to the enactments of an ordinanc passed in Session 8 of the Legislative Council o New Zealand, intituled 'An Ordinance to autho rise and regulate the Impounding of Cattle,'i respect of cattle trespassing upon enclosed lands But, for the purposes'Of-this present by-law, th term; 'owner' shall include any person for th Mmc being having the charge, care, and custod •of the animal so depastured as aforesaid."
