Saturday, May 21,1859. .- . -, '- Before the Resident Magistrate. . ■, .' Six seamen belonging to the brig, Robcrtina,now lying alongside the Albion Wharf, Nelson,were charged by Captain Davis with 'disobedience to lawful commands. ' ' , •It appeared upon the evidence of the Captain, that he had 150 tons of coal to delivej.1 into carts at the Albion Wharf, and upon requesting the, seaman to carry the same (the distance about one hundred yards}, the men refused to do so, each basket being about 140 pounds weight, alleging a3 a reason that they were for the most part physically unable, but would deliver the coal to the carts if wheelbarrows or tramway cars were employed. The captain gave them in charge on the plea of disobedience. The Resident Magistrate, on hearing the particulars of the case, told the caDtain he feared he could render him no assistance, as he (the Magistrate) considered he was asking the men to do more than their duty; had any vehicle been provided by which the coal could have, been .removed from the vessel to the carts and the men had refused to assist, then he would have: 'committed' them to gaol, but as it "was he could not interfere; the men had better go on board and assist in every means in their power to discharge the cargo. The men were immediately:taken .on board,by the constable. "''... , ■■..-, Michael Shannon,' of Nelson, laborer, was charged with being drunk .and'incapable of taking care of himself. '■■"'.■";.
