£1892 DAMAGES AWARDED IN MOKAI TRACTOR ACCIDENT CASE

A jury in the Supreme Court at Hamilton on Xovember 2 awarded £1892 damages to a former tractor driver who was involved in an accident while ploughing on a Maori Affairs Department block near Mokai in October, 195.3. II e is Ilobert James Pearce, aged 29, married, of Rotorua. Pearce claimed £2887 7s ld as special and general damages. This ftgure was reduced by 33 1-3 per cent, the figure the jury fixed as Pearce' s contributory negligence in the accident. Defendant in the action was L. M. Saunders and Co., Ltd., agricultural contractors, of Tokoroa, who einployed Pearce as a tractor driver on the ploughing contraet at Mokai Pearce was injured when his tractor, which lie and another driver were trying to extricate from the edge of a gully, overturned.
