S.M. Court.
(Before F. J. Burgess, Esq.) A short sitting of the above took place on Tuesday last. Donovan v. Smallman Bros.: Claim £7 14s. Mr Porritt appeared for plaintiff, and explained that a post dated cheque had been received from the defendants, which he declined to accept. —No appearance of defendants. —Judgment for plaintiff by default for full amount, with costs £1 6s 6d. Gallagher v. Trickett: —Mr Gil christ appeared for plaintiff, who claimed the sum of £27 10s for five bullocks supplied some 10 or 11 years ago, when defendant was in business in Te Aroha—Defendant gave evidence at some length, explaining that owing to ill-health, etc, he was unable to pay the amount, nor could he make any offer to do so.- The Warden said he was satisfied that at present defendant was not in a position to pay and declined to make an order —On the application of Mr Gilchrist the case was adjourned for six months. W. H. Field, who has been before the Court on previous occasions for drunkenness,procuring liquor during currency of prohibition order, etc , pleaded guilty to a similar charge and was convicted and fined £l and costs 7s. Two weeks were allowed in which to pay the amount.
