The charge against 0. G. Walmsley, auctioneer, who was arrested for theft,- is that he oni or about February, 1907, having received the sum of £l2 8s 9d, requiring him to pay the same to Tlios, Tierney, of Waih'i, did fraudulently omit to pay thesame; also at the same time having. ... received, the ; f sumi of £4O, requiring him to account for the same to Time . Tierney, and fraudulently omitting to. do so.
