IS A TRACTION ENGINE A NUISANCE.
The Court of Appeal in Lonilon, consisting of the;Master of the I?oils anil Lord Justices Lindley and Lopes, gave Judgment in the appeal of Mr Eliiott Galer, proprietor of the Royal Opera house at Leicester, from a in Igment of Mr Justice Stephen, holding that the defendants wete not responsible for the personal injuries sustained by the plaintiff through his horse taking fright atone of the defendant’s traction engines on the high road near Leicester. Mr Bosanqnet, Q.C-, for the appellant, submitted that judgment should have been entered for the plaintiff in the sum of L 55 found by the jury. The judges now laid down the very important dictum that even if the Locomotive Acts were complied with, the proprietors of a traction engine worked in such a way as to frighten a horse of ordinary nerve ware liable for damages in the event of an accident.
