WARDEN’S COURT. TE AROHA

TUESDAY, FEBRUARY 4th, 1890. (Before H, VV.NorthcroftEsq., Warden) Applications for Protection : Richard Bu ke, for protection for Welcome L. Ltd-, Wuiorongotnai, for four months’. Granted. Application by Thos. Quoi, for protection for the Montezuma Special Claim, Te Aroha, to work with two men for three months. Mr W. Meldrum, solicitor for applicant, briefly stated the circumstances relating to the taking up of the giound, subsequent working of same, and applicants desire to be allowed to further prospect for a time with two men, in

order to derelope the reef before going in for expensive workings, etc. Two miners working on the mine, (one named Ellens) objected to the granting of protection, stating as a reason for not having lodged their objections in Court in the usual way, that, the notice of intention to apply for protection wns not posted on the ground in the t ine required by the Mining Act., It came out in evidence, however, that although the objectors were right on a tecnical point in this respect, yet they had the notice in their possession in proper time, it having been given them to post on the ground, they being in the employ of applicant. The- War-ien, addressing the objectors, said it wn9 quite evident they were fully aware of the intention to apply for protection and they should hare lodged their objections in Court in the ordinary way. They could not come in and take the Court by surprise at the eleventh hour ; that could not be allowed. However it appeared to him that the notice hul not been actually posted on the ground in time, lie would, therefore, give applicant fourteen days protection, and he could meantime have fresh notices posted, and apply again for protection. Application for Residence Site : Cornelius Murphy, for residence site, allotment No. 6, Block 27, Te Aroha Granted. Applications for Forfeiture : A num ber of plaints for forfeiture of claims for non-working, were adjourned till next Court day, owing to the absence of the Mining Inspector.
