Til** Cyledonian Cask. — In a telegiam yesterday I mentioned that the Caledonian Goldmining Company had decided to appeal to the Auckland Supreme Courb against the decision of Mr Warden North - eioit in the recent case of Alfred Sawyer v. that Company, in which plaintidwas awarded i! 375 damages and costs forinjurie^sustained by him on the 26th of March last, when descending the Caledonian shaft in a cage. (3) There was no evidence to show that it was reasonably practicable prior to and up to the happening of the accident, and injuries before referred to for the defendant to comply with sub -section 23 of section 207 of the Mining Act, 1886, but on the contrary tho evidence proved that, such compliance was not reasonably practicable. (4) That the evidence proxed that' the complainant was guilty of contributory negligence. (5) That the damages awarded to the complainant are excecsive.
