DEEP LEVEL CROSS. IMPORTANT JUDGMENT.

MINING NEWS.

Auckland, August 21. Air important judgment in connection with an application re tbe Deep Level Cross Goldmining Company, Limited, was given by His Honor Chief Justice Prendergast at the Supreme Court this morning. The judgment was a petition by the Bank of New Zealand (a creditor) that the Company should be wound up, on the ground that resolutions passed by the shareholders in the same direction were invalid. The circumstances of the case have been previously reported. His Honor gave judgment at considerable length, and concluded his remarks as follows : Had I more doubb on this question than I have, I sJiould still, in the interests of the Company and its creditors, have granted the order in the present petition, for it would be very inexpedient that in realising the assets there should be any doubt as to the validity of the proceedings. Costs must be taxed and paid out of the assets.
