Invjbrcargill, April 18. In the cross action, Bank of New Zealand (claim £965) v. Wilson & Tame (damages £2,000), the jury were locked up all night to decide the following issues : — Was there any agreement made as alleged by the defendants in their counter claim, and if so to what damages are the defendants entitled. They failed to agree and were discharged. Sir Kobert Stout proposed to oh ivith the next case in which the Bank claimed £1,540 and the defendants £3,000 damages, but the Judge said it was impossible to hear the case at this sitting, as the Easter holidays intervened, and he had to be in Dunedin on Wednesday. Sir Robert Stout said he was willing the Judge's notes should be laid before the second jury, and witnesses called on fresh points, but Mr Chapman,, for the Bank, would not consent. Sir Robert Stout then said he was agreeable to take the case before the Dunedin jury. The Judge thought that the best plan. A temporary adjournment of the Judge and counsel to Chambers for conference here took place. On resuming, the Judge said he had suggested the removal of the case, an} a motion to that effect was before him and would be heard in Dunedin. The two actions would probably be consolidated &o that both could be tried together at as early a date as possible, If it could be finally settled the venu would be changed to Dunedin. This closed ,the session and the Judge left for the north by express.
