APPEAL DISMISSED.

Ls Banco Court yesterday afternoon the application tor u. now trial in the case of Stapleton v. J. Smith, of To Aro Houfce, beavd recently, in which the jury gave a verdict for £500, was refused. Judge Richmond, in delivering the judgment ot the Court, s>aid that, the award seejned somewhat excessive to him, and if he had been on che jury he would probably not have given s>o much. That, however, was not the question. The Court had to determine whether the verdict of the jiu-y ought to be interfered with. The Court was ot opinion that the jury were justified in giving what were termed vindictive damages, and under those circumstances he saw no reason for interfering with the award. The Chief Justice concurred in this opinion.
