The counsel for the accused *aid he had been 28 year.s in the bank, and had always borne an excellent character, that his brain had become atteeted by constant and monotonous work, and that he had no* appropriated the money to his own use. but had paid it away in mistake in caching cheque^ In support of this statement several witnesses who had returned money paid in exceoc wcte examined. The Bench sentenced pii&oner to 12 months, and remarked that if the circumstances of the case were laid hefore the C!ovemov he might feel justified in remitting the sentence.
