LATEST PROM THAMES. IMPORTANT MINING CASE.
Thames, Last Night. A case possessing some interest to the mining community was called on in the Warden's Court to-day, being the first for the forfeiture of a claim that has boon heard at the Thames under the new Mining Act. Under the old Act only the Mining Inspector could institute proceedings and have licenses forfeited for non working, but under the present Act anyone wan these proceedings, although in each case the result is the same, viz., that the ground if forfeited must be sold by auction by the Warden. The application in question was that of W. S. McCormick, who asked that the Consols licensed holding (formerly Dart (jr. M. Co.'s ground )J situated in Hape creek, belonging to J. 11 . Witheford, should be forfeited upon the following grounds : " That the grantee has not complied with the conditions upon which the license was issued ; that he has done no work, or very little on the said holding ; that he does not intend to work the same, and holds it for speculative purposes only." After hearing voluminous evidence the Warden fined defendant £10 and costs £3 10s, in lieu of forfeiture.
