It appeared that defendant, as agent for the Trustees in Murray's estate had employed plaintiff. Defendant admitted liability to the extent only of £0 12s. which amount he had been paid into court; he deducted L:> 4s as being clue the Trustees for contra account. Judgement for L 5 1-9 with cost 3 L 3 ;">3 in addition to the amount paid into Court ; the amount to he held by Clerk of Court till next Court day to enable defendant to bring a cross action for the amount of contra account.
