AUCKLAND Last Night. At the Supreme Court to-day John Me Geohan, Dennie Foley, and John Foley wsre charged with stealing cattle, the | property of William Morgan, of Waitekauri. Mr Hesketli appeared for the Foley Bros., and Mr Wbitaker for McGheehan who pleaded "guilty," the other prisoners pleaded " not guilty." Ma Williamson, Crown prosecutor, said ho had looked into the depositions and found that the ovidence did not substantiate the charge against the Foley s ; he would therefore offer no evidence against them. His Honor then directed the jury to return a verdict of not guilty against each of the Fpleys, and the jury having- done so tfoose prisoners were discharged. His Honor said with reference to McGeohan he had previously been convicted of cattle st.-al-ing, and he could not impose a less sentence than five years penal servitude on each of the two charges, the sentences to run concurrently.
