THE PRELLER MURDER. A Motion to Dismiss the Case Before the Supreme Court.
Washington, January 9. —The AttorneyGeneral of Missouri submitted a motion ia the Supreme Court to dismiss, for want of jurisdiction, the case of Hugh M. Brooks, alias W. H. Maxwell, who is now in V^iaon in St. Louis under sentence of death for the murder of Charles A. Prellor. Tha Attorney-General maintains that the case does nob present a Federal question, and that the Court cannot take jurisdiction over it. Counsel for the prisoner argues m a voluminous brief that the case does present Federal questions. .' G&neral of Missouri has virtually the effect of bringing Maxwell's case before this Court at one©' on ita merits, and if the motion to dismiss be granted, it will, of course, be equivalent to! an affirmation of the sentence of defttk pronounced by the State Court.
