Mr Campbell wished to know from whom Mr Ikiumio received liis ins' motions to appear. In nnswor 1o the Court Mr Han me received his insl motions from Mr Ehienfiied, who held the pioxies of 'a number of eroditois. Mr. Campbell In*]. l that. Pus was nob sufficient as Mr Ehrenfried himself had not pioved. — Mr Baume retorted that his ! inrlniclions h-id been comfirmod by Mr Lew ami another creditor. Tho debtor \>as then placed in the box and examined by Mr B.tU'ii re his method of keeping book =5 and tho disposal of his hotel receipts. Between the 23rd an 1 27th August, "hsSO, (when distress was levied) he- withdrew Ll2 L'>s 2d from the bank an 1 paid it away along with his hotel receipts during those days, viz., L2S to Hay (.solicitor), Ll2 to his pisfer-in-law, Miss Coleman, L 2 7s to Foy Bios., and sundry other items. — Cross-examined by Mr Campbell : On the 27th August he paid L()(i into the bank. — Mr Hould (account mt in the Assignee's Office) gave evidence as to the preparation of the statement of the debtor's receipts and expenditure. — Lewis Ehrenfiied, brewer, was placed in the box by Mr Campbell, and gave evidence. He stated that thtee years ago he put tho debtor (then without means) in the To Arolia Hotel. Witness's monthly accounts were regularly paid until the last three months. Debtor bought a good deal of furniture and gave witness a bill of •sale over it. lie seized for rent I on the 27 tU August. Debtor entered tho house owinaf witness L,->() 0 for furniture and he left it owing him £1,400. Debtor cleared the most valuable furniture out of the house, and then invited witness to come up and take? possession of tho half empty house. Counsel then addressed tho Court, Mr Baume contending that (his was a case in which the criminal jurisdiction of the Court siioul 1 be exercise 1. His Honor s lid he wa? veiy lolh to exercise the powers referred to, but in this case he confessed there, had been very great carelessnes- in keeping the books. After hearing ?\[r Ehrenfrie lit seemed, 100. that there" had been something more than carelessness and lrid he been '-h uv><»,i with iviiovuiLT <;<)'> li fioitl thehoH his sentence would h.i\e been very seveio. and as it was he ordered that thp debtor should be impiisoiuKl j with hard labour for a month. In the light of these circumstances, Mr Tole consulted with the ju l#o, and with his aeqtiiescence recommeti'led the Governor to order Warren's liberation, which has accordingly been done.
