Action Against the Union s.s. Company.
In the Banco Court on Tuesday, before His Honor Mr Justice Fawcett and a jury ot four, the action brought by Alexander McWhinnie, horse importer, against the Union Steatnfchip Company of New Zealand, for £1,000 damages, for breach of agree njont to convoy a horoe in safety from Sydney to New Z3aland, was concluded, the result being a verdict for the plaintifl. The plaintiff's case was that the defendants agreed to ship from B\dney and carry eafely in their steamship Wakatipu, to Port Chalmers, New Zealand, a horse named Sr. Vincent; that they promised to use proper are in shipping the horse; that thoy undertook to provide sufficient appliances and tackle for so doing; that, instead of carrying out that agreement, they used improper and insufficient appliances ; and that while the horee was being shipped the tackle gave way, and the animal was thrown down and injured, and afterwards died in conquence of the injuries ifc sustained, The damages claimed wore £1,000.
