Defendant was just then about to be married to plaintiff's daughter, and swore positively that plaintiff voluntered to do all the work now charged for free of expense and in a friendly way at the time > 9 in order to make his daughter's future home more comfortable; and in lieu of a wedding present; with the exception of putting up a lean-to which was erected at defendant's request, and for which he had allowed plaintiff a fair sum. Plaintiff swore on the other hand that the work was done in the ordinary way of business at defendant's request, and that the charges he had made were fair and reasonable. Plaintiff's son, a youth of about 14 j years, swore to hearing defendant rei quest his father to do the work. It was proved that plaintiff had never furnished any statement of account to defendant during all the time winch had since elapsed or until the previous week; and defendant alleged he would not have done so then, were it not that inhis capacity as bookkeeper to Messrs Smith and Seddon he had been obliged to sue plaintiff for the amount of an account owing to that firm for meat supplied. Mr John Farrell, builder, gave sworn evidence to the effect that the amount defendant allowed plaintiff for building the lean-to was ample. Mr D J. Frazer, ironmonger, was also sworn in defendant's behalf, and stated that plaintiff got paper, varnish, etc., from him at the time be did up the cottage, which was charged to defendant's account, and told him (witness) at the time " not to put it down to his account as he was getting nothing for the job, but was just fixing up the place for them." Judgment was given for defendant with tcoss £1 19s. A number of other cases that had been set down for healing were settled out of Court.
