DISTRICT COURT, THAMES. (Before H. G. Seth Smith, Esq., District Judge.) Tuesday, June 3, 1881. IN BANKRUPTCY.

Bk Thomas Caldwbll. — The public examination of this debtor had been adjourned from a previous Court day in order to obtain His Honor's judgment upon a case stated by counsel in reference to a bill of sale held by Wells and Souttei'. Judge Smith gave his opinion that the bill of sale was invalid, and the creditors were entitled to the property mentioned in it. Mr Carpenter intimated his opinion that the estate had been sufficiently investigated, and His Honor declared the public examination complete.

He Chas. H. A. Tonor.— Mr Miller appeared For the debtor, wlioWas brought up for public examination. In reply to Counsel, he swore that he had ,a:i veil up all Ins property to the official assignee. His liabilities exceeded his assets by from £300 to £400. The excess was caused by his building largely «t Te Aroha, prior to the decadence of the field. Tlie buildings and furnishing cost him about £900, and he had opened it as a hoarding house, for which there was a great necessity at the time. He had borrowed £500, giving a mortgage and bill of sale over the property as secu ity. The mortgagee foreclosed, offered the property by auction, and bought it in at the amount of the bill. In consequence of the losses in this respect he had been unable to meet his liabilities, and been forced to file. Mr Carpenter said he believed all available information had been obtained, ami His Honor declared the examination complete.

Rm Thomas Scott. — This debtor was adjudicate I a bankrupt and Mr Carpenter appointed deputy-assignee.
