ASSAULT CASE. Auckland, March 1.

Tim cross cases of assault and indecent language between Edward Dines Halstead and Samuel Young were heard yesterday afternoon befoie His Worship the Mayor and Mr F. H. Hull. Mr Hugh Campbell for Mr Halstead, and Mr Brassey for Mr Young. The cases arose out of a quarrel in connection with an action previously heard in the Kesident Magistrate's Court. The parties got into a state of excitement, strong words were used, and Mr Young received a blow from his opponent. The witnesses examined were George Lend rum, Charles Fry, Wm, Redgate, John Kitchen, and Samuel Webberley. These witnesses were present at Ellerslie on the 22nd inst., and saw the disturbance between Halstead and Young, and were quite positive both as to the alleged language being used by Young, and the blow given by Halstead. Mr Lendrumsaid Mr Young's language was very offensive and aggravating, in fact, all the witnesses heard, more or less, the epithets applied to Halstead by Young, such as " b pimp," and " quack." The evidence in both cases was the same, and finally the Bench decided to impose a fine of Is and costs on Halstead, and dismissed the charge against Young, on payment of costs. This morning a fresh information was laid against Samuel Young by Mr Brassey in an amended form, for using obscene language towards Edward Dines Halstead, and which may come before the Police Court on Tuesday next.
