The Clerk of- -Court having read the information. > His worship Raid it was laid under the Vagrancy Act. Defendant said he would plead not guilty ttf the charge, us laid undf-r tho Vagrancy Act, but wnuM aeknowlede^ that under great provocation he had used lanjrnsige privately, mr which he expressed great r-gret, and if MrCimpholl was disposed to accept that anology, fie would be wining so to end the enfte. Proven toi\said he was not willing to accept the apology a^ given. The wordy were used in a public place, and were calculated to provoke a breach of' the peace. He thought defendant .should also tender a contribution to some institute. Dofendant said in that case he should withdraw his'apology. • Prosecutbrtanid he would like Mr Cuff to promise not to repeat the offence. Hjs Worship considered it was quite a private affair, not one against the public, and recommended that the apology be accepted This sugg 'stion was acceded to 1 .
