ALLEGED MANSLAUGHTER.
! AUCKLAND, July 1. The re-trial of Alfred Thomas Percy Dare, on a charge of having committed manslaughter by killing Mr A. J. Horton at Penrose on January 26, was commenced at the Supreme Court today It was alleged that the accused was the driver of a motor car that collided with a bicycle ridden by Mr Horton, who sustained fatal injuries, j Evidence was in the main the same as that given in the previous trial, i Dr Beane stated that he saw the accused, at the request of the Crown Prosecutor.’ on June 14rli, to examine him i n regard to alleged shell-shock. Counsel for the accused here objected to the evidence of Dr Beattie beingadmitted. The Judge said he would admit the evidence as to the result of the doctor’s examination. Witness then said he came to the conclusion that accused was normal, beth mentally and physically. His Honour said he thought this was as far as witness should go. He was only entitled to give further evidence that was not. in reply to questions put by him to accused. The evidence was subject to counsel's objection. Witness, in further evidence, said accused had told him he had run r a main on a bicycle. Cross-examined,' witness said he questioned the accused to test his mental condition. Accused would not. , know in whose interest he was acting. The Court adjourned.
