SHOULD A DOCTOR TELL?
; LONDON JUDGE'S OPINION. Once more that old question, ''Should a Doctor tell?'' has cropped up, this time in the London Divorce Court. ~ i It arose on the point whether a doc- : tor is entitled to give evidence on 1 confidential matters gathered by him in the secrecy of the consulting room : concerning his patients. i Mr Justice McCardie was the Judge • before whom the question arose when ! Dr Soloman Kadinsky ,senior medical officer at Westminster Hospital, was called to give evidence as to disease ; for which, it was said, he had treated i a woman, resulting, so it was alleged. ■ from hi s husband's misconduct. On entering the witness-box the . doctor handed a letter to the Judge 1 from the chairman of the house' com- ; mittee of Westminster Hospital, enI closing a copy of the regulation under I which patients are' treated, and sax - ing: "All information obtained in regard ro any person treated under the scheme shall be regarded as confidential.'' ! Unless ordered 'by the Court to do . so, he objected to make any statement. : It would be appreciated by the doe- '■ tor, said the Judge, that in courts of j .justice there were even higher eonsidI erations than those which prevailed-in | the position of medical men. Apart from the obligations imposed |by the order of the Judges, it was : most desirable that there should be the ' : utmost loyal observance of that co-i----j lidence imposed On doctors by patients. Always the history of the profession i had been most honourable. j 'Thereupon the doctor gave evidence, j ■ ; "What muddle seperfLuous prepaj ration, makes." —Stanus.
