The plain‘tiff was ilicapacitatecl from work following an accident which happened to ihim in May. 1919, while he was in the ,clllplo_\' of defendant, but the matter was complicated because he was sllff fering from arterco calerosis (progressive hardening of the artei-ies)§, which was bound to incapacitate him sooner or later. The question for the Court was whether he should be awarded a lump sum in respect of future incapacity in place of a‘\T'eel<l_§_: ‘allowance such as he had receive’(l ‘since his accident. _The Court decided that the probable period of incapacity from the accident was two years, and ‘awarded a lump sum of £2OO to cover that period, reserving the right to plaintiff’.s dependents to claim compensation should he die within that period on the ground that his death was due to the effects of the accident.
