Alleging that his Wife colnmittecl~ adultrywhile he was absent on active service, a Hamilton confeetioner 4* named George Lionel Stroud sought t‘o~ have his marriage with Frances Jubilee Mary .Stroud annulled before Ml‘ Justice Cobper and a jury, at. Hamilton, last Saturday. He also claimed £3OO damages against" Joseph Smith, ’ who Wasnanied as co-respondent. 9 It was shown that the couple were ' married in Wellington in 1905, and‘ lived subsequently -at Taihape and Hamilton. There were frequent quara rels, culminating in a legal separation. at Hamilton. While petitioner was, - away at the war the wife staye dwith co-respondent as his wife at a Wellington boarding house, where she was recognised by the proprietor, at whose Wedding she had acted as bridesmaida When the proprietor addressed her as Mrs Stroud she said she :1-ad seem-ed a divorce from Stroud, and W3.-S teen Mrs Smith.
Asworn afiidavit. was read from the constable who served co-resp3ndenr,.in which the latter was said ‘o have mlmifted adulfry, and to have added thaf hewzis expecting service, as it was jusr his luck, for he was a‘.wa.y.~*§ in troubde. He was also alleged to have sfated that Stroud had a poor chance of getting £3OO out of him. After 3. short refirement the jury gave a verdict for £l5O damages. His Honour granted 21. decree nisi ‘to be made absolute in three months.
