QUESTION OF DAMAGES.

LONDON, Feb. 10.

' Sir Henry i\lcCardie, in the Divorce Court, in an important considered judgment regarding the damages to which '3. husband is entitled when his wife is ilured away, laid it down that damages should be based on the following I considerations: (1) The actual value of '3. wife to her husband as housekeeper or help in business; () proper compen- ' sation for injury to the husband ’s martial honour; (3) if a wife was of :1 [wanton disposition this lessened her value; (4) damages should not be given against a co-respondent who is not aware that a woman was married‘ (a wife who poses as single must. be} ‘deemed Valueless). The Court has no} right to punish misconduct, and dama-i ges should not be punitive. A woman‘ could not sue another ‘woman for tale! in her husband away. The law held! that the wife had no sur,-h right. to her‘ husband’s services as a husband pos-i sessed regarding his wifeis.
