MOTOR CAR CASE.
CLAIM AND 'COUNTE‘R~CLAIM.' At the Magistrate’s Court on Tuesday before Mr J. G. L. Hewitt, ‘S_M., and Mr A. G. McGregor, of Mangaweka, assessor, a case was heard in which Taihape Motors Limited claimed to recover from Dr R. J. Boyd the sum of £74 13s 11d, balance owing for goods supplied and delivered, repairs effected, registration fee, and car hire. Dr R. J. Boyd lodged a counterclaim for £42 65 for repairs to a car rendered necessary by the alleged neg~ ligence in repairs, allowing oil to escape, etc. It was also alleged that defendant company had failed to keep the ca: properly oiled, and relying on the assurance of the company that the car was properly oiled counterclaimant’s car had suifered damage.
Mr Loughnan al'p'f)eared for Taihape Motors Limited, and Mr R_ A. Davies for Dr Boyd. ' Expert evidence was called on both sides, after hearing which the Bench reserved judgment. ,
1 At the Court this morning, Mr Webtster, Clerk of the Court, read the judgment of the Magistrate and Assessor, which stated that the plaintifi company was" entitled to judgment, on its claim, for £67 15s Id,“ and that the defendant .(Dr Boyd) is entitled, on the, counter-cl_a.i,m, to judgment for £4O Bs‘ 3d. »'l,‘hat‘is to say, judgment is} for’ -the plaintiff for the difference, to wit £27 6s. .
