The accused are Ernest Claude Gibbons (aged eight) and Richard Claude Reihana (aged ten.) The evidence, as at the Inquest, showed that three children were seen near the bank of Kirikiri creek on July 19th. Subsequently the .boys were seen going home without the girl. Her. clothes were later found on the bank of the creek. The girl was unable to undress herself. Her body was recovered next day. The boys, when questioned, made statements incriminating each other. ■ Counsel contended that there was no direct evidence to justify sending the boys to trial. The Magistrate considered it a case for a jury and committed the children for trial at Auckland on August 13th. They were admitted to bail.
