George Wiliiam Terry was charged that he did on or about the 24!ft September iiio, at steal six cas’es of benaine, tnree cases of blasting powder, two ct/ses of gelignite, and 2uu detonators, valued at £25, the property of .Leslie Brooky. Leslie Brooky gave evidence of the loss of goods mentioned in the charge. David Anderton stated that he was formerly working for the accused. He was at Brooky’s fire. After the fire he had feed and drink with others at Mr. Cleavers house, then went to the stables. He and Wallace were there whdn Terry purposed stealing some of the explosives. He refused to have anything to do with it. Wallace and Terry went out and he saw them return carrying gelignite. They made four or five trips, each time bringing something. Benaino was put iu the office and explosives in the left. John Stewart Crighton, contractor, stated that he bought gelignite and caps from the accused.

Coustable Manly stated thaf about the end of February he interviewee the accused about a fire at Brooky’s. He asked about some gelignite that Terry had sold to Crichton. Terrs

said he got it frcm Mick Ryan. Terry did not know where Ryan lived. Terry admitted that what he had said about getting the explosives from Ryan was untrue, and said it was Bert Wallace who told him where the gelignite was and asked him (accused) to sell it for him. Terry said he sold a packet of gelignite and a tin of caps to Crichton, and that there was more where it had been planted. Terry declined to say where that was. Terry said he had an idea that Wallace got it from the side of the road on the night of Brooky’s fire, and that he believed it belonged to Brooky. Detective Siddells also gave evidence. No questions were asked by Mr. Ongley, who appeared for the accused, who was committed to take his trial at the next sitting of the Supreme Court at Wanganui.
