MERTON’S CLAIMS DISALLOWED,

LONDON, Oct 6 (Reed 10.45 a.m.)

Sir Samuel Evans, Resident of the Prize Court, in delivering judgment in the steamer Billister case, said the sole questions for decision were related to the Gunn Company’s claims for freight and Mertons’ for the return of £SOOO paid to shipowners in respect ■of freight. The president held that Mertons could not he receivers against the shipowners, Who discharged -their obligation by giving up,the lien on the goods for whomsoever the five thousand was paid. It was intended to preserve the goods for the owners, whom Meltons knew to be enemies, and to gain an advantage for themselves or their co-adventurers, the Metallgesellschaft They thus did not hesitate to engage in commercial intercourse with the country’s enemies. The claim was without foundation, and it required much assurance to launch the claim, and to persevere therein showed a reckless want of appreciation of the possible consequences. The judgment icf I{he Court was that the be condemned as a prize; that out of the proceeds £2546, balance of sum awatrded, be paid to the shipowners, and that Merlons' claims against shipowners and the Crown be disallowed.
