Judgment was given yesterday by Mr Crooke, S.M., at New Plymouth, in a case iii which Tinning v. Hills claimed for the return of a deposit paid in prospect of a land sale, which did not eventuate. The Magistrate held that, there was .unreasonable delay on defendant’s part, in completing the transaction and arranging to discharge encumbrances on the property. Judgment went for plaintiff. Heave to appeal was granted.
