RIGHT TO A NA M ~ INTERESTING LEGAL PC ' i’. AUCKLAND, Ai> S 27. Au interesting point, was a. jussed at the Supreme Court this mor; ing on the question of the right of a commercial firm to the exclusive right of a surname by registering it under the Companies Act The matter arose from 1- o* application by Dr. Dean Bam lord rndor the Companies Act, 1908, for the giving i.r permission to the firm of j. C. Sp so diner, THd., to change the name ■o that cf Spedding, Ltd. His Honour; I have some difficulty ”h‘out mrkipj thin order. It scorns to ,1 ’” f '■ would cum a monopoly to hr::-’ over a surname which they

mignt have obtained in the first place. '• he name must not be calculated to deceive. Dr Bairvfcrd: The name at present is T. C. Spedding. Ltd. His Honour; Yen. That in distinc■ive, but I cannot’ give you a monopoly the name cf Spedding. When one comes to the can.' cf a company’s name -■■■ has to consider the question cf deception. Thg question is a serious cue. x on will ft;.i iii (lie Sen'll at least one ■arm registered under the treading. In England they require, if. ‘here is already a surname registered ■t the same kind, that the same distinction shall be given. Dr Bamford : T can quite understand f hn objection if there were a Spedding already in existence. The Judge: I am pretty well sure : h‘ 'here is a Spedding and Son. Ltd., hi New Zealand. A man has no right tp turn his name into a limited company. He can use his own name or any name he chooses to trade under, but. when ho gets on the register he is

( ben put in a position of opposing anyone registering tha same name. You give him a right which he would net otherwise possess. You have hitherto

gone under the name of J. C. Spedding. I don’t think it is a matter of ■.•• pin.. ic rant the order. I am confident that it ought not to be allowed, as it is an encroachment upon the Tights which others might have. It gives your client a footing to the surname of Speckling under all company names, and anyone else would have to register under some other distinctive name. i' inaiiy, in older to give Dr Bamford an opportunity of answering objections His Honour adjourned the matter until next Chambers Day. SHIPPING SPACE. DIFFICULTY MAY LAST FOB TWO months. With regard to tha great shortage in cold storage space aboard outwradbcund vessels for the meat that is ready for export, the Prime Minister stated yesterday that he has great sympathy with the disappointment that is felt in CaWerlmry. The situation, however, seamed to have been quite unavoidable. He had done his best to get what steamers were available, but apparently the present difficulty

would last for two months. So as to exhaust every moans .of .getting assistance in the matter, Mr Massey cabled to the Imperial Board of' Trade asking that body if any vessels with insulated accommodation can be found that. th?v be immediately despatched to Now Zralnd in ballast. In view of tn e complaints which have come from Christchurch and Tlmam- as to the allotment of space-, Mr Massey also place dhirasolf in com-muni-:ilmn with Southland exporters 'o so • vhThar they would he willing to alh' w some of their allotment to go to CV.n--.•rbury. He, however, received a reply In the negative as they could do 'with a deal more accommodation at the present juncture. AUCK LA N D 3USi NE 5 S 31T £. SOLD TO CANADIAN FIRM. WOOL AND MEAT MERCHANT.

A HORSE HOSPITAL. I have just paid a flying visit to the military horse hospital at Mooy River, Picardy. There were 1(500 animals in residence. The hospital is surrounded by a forest once given over to herds of deer and wild boars. Mobs of sick horses lay about the base of, the sandhill receiving open-air treatment for catarrh, skin trouble and colic. For the last-named complaint big draughts of parafm was found beneficial. When under operation for shrapnel and other wounds, the horses are given chloroform. There is the, regular operating table. Attached to this veterinary hospital is a staff of 400 men, includin'eight army vets. All the horses that .-m

rive are classified according to the nn tare of their complaints. Some have to be destoyed at once. Others, although useless for hardships of war. arc fit for good work, and are sold by auction locally. The moment a horse is pronounced fit he is sent back to the front. A vet. told me that a horse becomes conscious of danger the moment it enters the fire-zone, and shrinks like a human being from the sound of the wailing shells overhead. During the first four months of the war the horse mortality has been brought down to lo p.er cent, compared with 50 per cent, of a corresponding period during the Boor War. Owing to the fine organisation of the A.Y.O. and other campS the percentage is falling even lower. The “Philadelphia Public Ledger” defines the Wilson Tango as “ono step forward, one step backward, hesitate, and reverse.” The same paper is responsible for the literary item that the Kaiser is inordinately fond of “Curfew shall not ring to-night.” It begins “England’s sun was slowly setting.”
