STEP-MOTHER RETAINS WHANGAREI HOUSE SUPREME COURT JUDGMENT Believing that it was the intention of Alexander McLeod to secure a beneficial interest to his wife, Edith Agnes McLeod, when he entered into a deed with his son regarding the possession of a house at Whaugarei, Mr. Justice Herdman, in a reserved judgment delivered yesterday, gave possession of the property to the wife. The action had been brought by John Alexander McLeod, a Hikurangi butcher, against his stepmother regarding a property at Whangarei. Plaintiff and his father had entered into a deed of conveyance regarding the property, in which it was a condition that the father and stepmother should live rent-free in the house during their lives, the sou paying an annuity of £lO4 as rent. Subsequent deeds between the two parties when the father left his wife to live with his son, released the latter from any necessity of paying the rent and eliminated the right of his father and stepmother to live in the house. This morning counsel pointed out that defendant, who was referred to yesterday as. plaintiff’s mother, was actually his step-mother.
