DIVORCE PETITION FAILS From Our Oxen Correspondent HAMILTON, Thursday. The defended divorce action in I which Louis Edwin Castleton sought! the dissolution of his marriage with ! Rose Violet Castleton, on the ground I of desertion, was concluded before Mr. | Justice Smith in the Supreme Court at.! Hamilton today. Mr. Ray appeared j for petitioner and Mr. McMullin re-1 presented respondent. In giving judgment his Honour said j it was obvious that the parties would I not live together again. It was clear : there was no agreement for a separa- j tion. The petitioner left his wife, and ! it was not established that he had had ; the Fairy Springs property to go to at the time. It was impossible for him to hold that the wife deserted the petitioner. or that the petitioner issued an invitation to his wife to rejoin him. The petition was dismissed, and costs were given against petitioner on the higher scale.
