ACTION AGAINST TRUSTEES Reserved judgment was delivered bj» Mr. Justice Smith, in the Supreme Court today, in the action in which Edward T. Ferrall (Mr. Rudd) proceeded against the trustees ol the estate o£ his father, Robert Ferrall, a farmer, of Parkhurst, Robert Ferrall and William Fallon (Mr. Richmond), for the taking of accounts. The court was asked to decide whether Robert Ferrall, one of the trustees, was entitled to remuneration ol’ £392 and living expenses for managing the estate, whether any of the debts in Mrs. Ferrall’s estate could be charged to the husband's estate, and whether defendant was entitled to have the outgoings on his lease paid out of hi 4 father’s estate. The court found ti at the defendant was entitled to be p..id £3 10s weekly and “found,” for the services he performed as manager between August, 1927, and October, 1929, hut that he was not entitled to have the outgoings on his lease paid out of the estate. His Honour also held that the beneficiaries had agreed to the payment of certain debts of the mother’s estate out of their father's estate. He also made an order for the taking of account*.
