FIVE FINES IMPOSED
FFARRINGTON POWER’S ESCAPADES PROMISED GAOL NEXT TIME
In delivering his decision at the Otahuhu Magistrate’s Court this morning in the case in which Ffarington Edward Lockhart Power appeared on six charges in connection with driving a motor-cycle, Mr. Levin said Power’s previous convictions totalled 14, four of which were for driving without licences. On November 9. 1927, his licence was cancelled for 12 months and he was lined £5. While still unlicensed on March 2S, 1928, he was again convicted and fined. Again on May 29, 1929, he reappeared for driving in a mailer liable to be dangerous to the public, and was fined £5 and his licence cancelled for five years. While that cancellation was still in force he reappeared on June 4 and was convicted and fined £5 for continuing to drive without the necessary licence.
“By your record,” said Mr. Levien, "you are quite capable of showing colossal impudence to the court, and if you appear before me again, you will go to gaol without any limitation on my part.” For driving in a manner which might have ben dangerous to the public. Power was fined £2 and court fees 14s; inappropriate number plates, £1 and 10s costs; no head lights, 10s and 10s cost; no tail-light, convicted and ordered to pay costs 10s; failing to stop when required by a traffic inspector, dismissed, and for driving a motor-vehicle without a licence a fine of £2O was imposed.
Pckver asked the magistrate if the penalty was “under a new award,” as he understood the maximum penalty was £lO. He stated that he had looked the question up and in the “washing-up clause” it stated that when there is no fixed penalty, the maximum fine was £lO. He was not sure, but was of the opinion that the information was in section 29.
After perusing the regulations, the magistrate said that apparently the offence carried a penalty of only £lO, so the fine was amended.
An application by Power for time to pay was refused.
