ASSAULT CHARGE FAILS
INJURY IN SCUFFLE A fracas in an hotel bar was, the reason why Harold Hart appeared in the dock at the Police Court today. Hart, a butcher, aged 38, pleaded guilty to being drunk in Hobson Street on Saturday. On a major count of assaulting Arthur Broughton he pleaded not guilty. The alleged assaulted man did not appeal when called, and a police witness also failed to answer the call for his name. Constable Chalmers said the trouble occurred at 1.30 p.m. on Saturday. Broughton was sober, but said he had been struck by accused. Five stitches were necessaiy to put his mouth in working order again. When accused was taxed with the assault he first denied it and then said he had merely pushed Broughton. Mr. Hunt, to accused: Tell me your story of the cause. “Broughton called me an offensive name in an hotel bar, and there was a bit of a scuffle,” said Hart. “His injury was probably caused by our heads knocking together.” On the charge of drunkenness Hart was fined 5s or 24 hours. “The assault charge is dismissed,” said the magistrate. “I haven’t enough evidence about it.”
