or shall sustain a broken jaw or collarbone.
CHILDREN’S ACCIDENTS (16) £ 5 will be paid to the parent whose name appears on the registration form in the event of an accident to his or her child over the age of six and under the age of 16 years causing broken arm above the wrist or broken leg above the ankle providing such accident is the direct result of one of the aforementioned and defined accidents and does not occur during employment PROVIDED ALWAYS that the above Undertaking and Agreement is subject to the following special conditions which are the essence of the contract, namelj. (a) The scope of the insurance is restricted to accidents happening in New Zealand and to steamers sailing within New Zealand territorial waters. (b) In the case of death, such death must result within 30 days after the accident. (c) That notice of the death and the accident be given within forty (40) day* after the accident by the subscriber or representative to THE SUN Newspapers. Ltd., Auckland. (d) IN THE CASE OF PERMANENT TOTAL OR PARTIAL DISABLEMENT that notice of the accident be given by the subscriber as aforesaid within fourteen (14) days of the accident. fe) IN THE CASE OF TEMPORARY TOTAL DISABLEMENT that notice ©f the accident be given by the subscriber as aforesaid within seven (7) days of the accident. <f) That Medical Certificates and other necessary information be furnished by the claimant upon request. (g) That the total liability in respect of claims arising out of any one railway accident or disaster which results in the death within thirty (30) days of more than one person shall not exceed the sum of £1,000; in any such event the said sum of one thousand pounds (£1,000) will be paid pro rata. <h) That the total liability in respect of claims arising out of any one accident o disaster, other than railway accidents, which results in the death within thirtv days of more than one person shall not exceed the sum of one thousand pounds (£1,000). In the event of such happening the said sum of one thousand pounds, shall be paid pro rata. (i) That no compensation shall be payable for any accident happening while the subscriber is carrying another person or riding upon a luggage or pillion - carrier of a cycle or motor-bicycle. (j> That no compensation shall be parable for any accident sustained while the subscriber is in a state of intoxication or resulting from suicide or attempt thereat, an overdose of drugs, insanity, war, riot, or civil commotion or for an injury arising out of and in the course of his or her employment save as allowed in clauses 2 and 6 hereof. (k) That in the event of any dispute between the subscriber and THE SUN as to whether such disablement render the holder temporarily or totally unable to follow his or her usual vocation. St is agreed that such dispute shall be referred to the decision of a medical referee to be nominated by THE SUN whose decision shall be binding upon the parties. (l) That the subscriber was not a cripple at the date of registration. (m) That the wife or husband of a Home Delivery' Subscriber ordinarily residing with him or her shall be deemed to be a Home Delivery Subscriber. <n) THE SUN reserves the right to amend or terminate this offer at fourteen days’ notice, such notice to be published in THE SUN. <o> Conditions previously published are herebv cancelled, and the foregoing con - ditions shall apply until such time as they are altered or withdrawn under paragraph (r»).
