MOTOR-CYCLIST’S CLAIM
MILK-VENDOR SUED FOR DAMAGES JURY INSPECTS SCENE The jury trying the claim for £ 935 damages by a. motor-cyclist, Alexander Bruce Black, against 11. A. Bassett, arising out of a collision, inspected the scene of the accident this morning before continuing the hearing of the case in the Supreme Court. Air. Justice Herdman was on the Bench. This is the second trial of the case. The claim arose out of a collision between the motor-cycle and it motorvan driven by an employee of defendant. at the intersection of Hillcrest Road and Station Road, Papatoetoe. on the morning of March 15, 1929. The .plaintiff alleged that the accident was caused by the van-driver's negligence in driving on the wrong side of The road, at an excessive and dangerous speed, failing to keep a proper lookout, and failing to give warning of his approach. Defendant denied that the vandriver was negligent and alleged contributory negligence by plaintiff, in rounding the corner on the wrong side, failing to keep the motor-cycle under proper control, failing to give warning of his approach and to keep a proper Air. North croft and Air. Stevens appeared for the plaintiff and Mr. Meredith and Mr. McCarthy for the defendant. (Proceeding)
