RETRIAL OF MOTORIST
FATAL NEGLIGENCE ALLEGED The death of an elderly man following his being knocked down by a car in Ponsonby Road on the evening of May 17, was recalled before Mr. Justice Smith, in the Supreme Court today, when the driver, Andrew Smith, stood his second trial on a charge of negligent driving, causing death. Mr. V. N. Hubble conducted tile prosecution and Mr. Allan Moody defended the accused. The victim of the accident was William John Humby, aged 67, who, according to the evidence for the prosecution had just, alighted from a tram and was standing on the rails waiting for another tram to pass before he crossed the road. The car did not stop, but was later traced by the police, and was found to he damaged with bloostains on the front of it. On being interviewed, Smith at first denied being in Ponsonby Road or having an accident, but later confessed he had driven along that street. < Proceeding.!
