CLAIM FOR WAGES
EMPLOYEE GAINS £2O 15/In the Otahuhu Magistrate’s Court yesterday Ernest John Lawson Smith (Mr. Bieimacki) claimed the sum of £lO2 15s 6d from A. and G. Bradley (Mr. J. L. Conlan) for wages and overtime short paid by defendant while plaintive was employed by him in a box factory at Papatoetoe. Smith said he was employed as a head sawman in the box factory owned by A. and G. Bradley at Papatoetoe. Ho commenced working at the factory on February 4, 1929, and had arranged to work for £1 10s a week and found, which they agreed would equal £ 3 a week. In his capacity as head sawman, he was entitled to 2s a day extra, and fulfilling the duties of saw doctor entitled him to a further 2s a day. There were four other employees at the factory, in addition to a number of schoolboys. He worked five nights a week, but did not receive any overtime. Bradley said he made no arrangements with Smith regarding overtime, as the business would not stand it, and he had often told him that it was not necessary to work overtime. He Claimed that Smith could not have worked the time as stated by him. In giving judgment for plaintive for £l2 15s wages and £8 overtime, the magistrate, Mr. F. H. Levien, said it was impossible to estimate the amount of overtime worked, which varied according to the statements of the plaintive and defendant. The amount was arranged by agreement between the two parties.
