ACTION FOR COMPENSATION A New Lynn farmer. Matthew William Neville, was non-suited by the Arbitration Court today on his claim for compensation against Alfred Buckland and Sons, Ltd., auctioneers, of Auckland. Plaintiff claimed that while he was employed driving a cow from Henderson to Westfield on October 2, ISC*', the horse that he was riding fell. He broke his leg in the fall and claimed that he had been totally incapacitated to date. Mr. Bagnall. who appeared for the plaintiff, said that an agreement had been reached on the amount of compensation. if the court held an amount was payable. Mr. West represented the defendant. In granting a non-suit his Honour held that plaintiff was not an employee or servant of the defendant firm, and no contr#ct could be proved.
