COMPENSATION AWARDED
£1,700 FOR LAND TAKEN AT PANMURE ACTION AGAINST P.W.D. The sum of C 1.700 as full compensation for hind taken, and for injurious affection of the balance, was awarded by the Compensation Court today to James Donald, of Auckland, on his claim against the Public "Works Department. The claimant sought £3,820 compensation, including £1,200 for 4il acres, taken by the department. £720 for injurious affection of the remaining 46 acres, and £1,900 for diminuton of the value of the residue on account of the existence of electric transmission lines. The property concerned is at Panmure, overlooking the Tamaki River. The court comprised Mr. Justice Ostler, with him Mr. John Alexander and Mr. J. B. Paterson, as assessors for the Crown and the claimant respectively. Mr. Justice Ostler said the court's decision was unanimous. There had been a great difference of opinion on various points, but these had been reconciled from a desire to save the parties the costs of another case by compromise. The court held that, in addition, the Crown Was liable for the cost of fencing when desired, and when that time came the Crown was to provide one right of crossing for vehicles and stock, and to erect suitable gates in the fences. Xo interest was allowed because the claimant had had the use of the land up to the present time, with every little disturbance, and would no doubt continue to have the use of tho land until the fences were erected. Each party was ordered to pay its own costs and assessors, whose fees were fixed at 27 guineas each.
