WIDOW CONTESTS WILL
SEEKS FURTHER PROVISION Press Association WELLINGTON, Monday. The Court of Appeal was engaged today in hearing the appeal in the case of Isabell Sheppard Poison, of Wellington, a widow, against Donald Murray Poison, Jessie Poison and Elsie Torrence Bright, all of Wellington. Appellant is the widow of Angus James Neville Poison, late of Wellington, an agent, who died at Auckland in December, 1927. By his will deceased made provision for the sale of his various assets, and after certain small specific gifts to charities, the balance was to be divided, and a onefifth share given to appellant. Defendants are alsp each entitled to a one-fifth share, and the other one-fifth share is to be given to charities. The value of estate at death was approximately £5,380. Appellant in May of last year brought an originating summons under the Family Protection Act for further provision out of the estate. Mr. Justice MacGregor ordered that appellant should receive, in addition, so long as she remains unmarried, the annual income on the one-fifth share given to charities. Appellant now appeals on the ground that such allowance is not sufficient. The hearing was adjourned until tomorrow.
