TIMBER LANDS DEAL

DR. RAYNER’S SUIT AGAINST GOVERNMENT FULL COURT HEARING Preliminary legal argument in the action for damages launched by Dr. F. J. Rayner, of Auckland, against the Government, over alleged uncompleted timber land deal in the Rotorua district, will be heard by the Full Court In Wellington next week. The case is expected to commence on Monday or Tuesday. Mr. Justice Ostler, who has been presiding over the Supreme Court in Auckland, leaves t' ’-j evening to attend the sitting. The land cr ~med coir - ' * zs about 5,400 acres, the timber rights over which are alleged to be valued for the purposes of the deal at £IBO,OOO.

It Is alleged that an agreement was concluded between Dr. Rayner and the then Commissioner of State Forests, Mr. K. S. Williams, giving the Government an option to purchase, the sum of £35,000 being named as the sum for this purpose. The agreement stipulated the Commissioner must notify his intention to exercise the option by December 10, 1928. The subject was mentioned in the House last session, and was then stated by the Minister of State Forests, the Hon. W. B. Taverner, to be subjudice as the matter was before the Courts. It is understood the Full Court argument will revolve round the point whether the action for damages can proceed.
