MOTORIST STRIKES TREE IN ROADWAY £53 DAMAGES AWARDED Press Association PALMERSTON NORTH. Today. Reserved judgment was given toy Mr. J. L. Stout, S.M,. in the case wherein W. J. Frew sued the Palmerston i North Borough Council for damages 1 received in a collision with a tree in ! Cuba Street. Plaintiff claimed £9l ! 2s 6d. In the course of his judgment the magistrate said the tree was situated j about 14 feet from the kerb of the footpath and was not protected in any way. The tree had been looked after by the staff of the defendant council for many years. In the magistrate’s opinion the tree, on a dark, rainy night, was a source of danger to the motoring public and the defendant had taken no reasonable steps to minimise the danger, plaintiff apparently having kept a reasonable look-out. The total damages allotted was £53 4s. Security for appeal was fixed at £ 20.
