THROWN FROM JIGGER
LABOURER SEEKS COMPENSATION FOR INJURIES ACCIDENT AT HUIA DAM Thrown from a jigger on which he was travelling with other Huia dam workmen, Charles James Flowerday, a labourer, received a fractured pelvis, for which He claimed compensation in the Arbitration Court today against the Auckland City Council. The accident occurred on Auerurt 5 last year, the vehicle being derailed by a boulder on the line between Huia and the construction camp. Flowerday, who was a platelayer, asserted that he was injured while proceeding to work and had been incapacitated until the present. He claimed £■ 64 6s 4d for injury and £3 15s 8d weekly from December 2 for the further period of incapacity. The defence denied liability on the ground that Flowerday was not within the area of his employment. Mr. Tuck appeared for plaintiff and Mr. Johnstone for the defendant. In evidence, Flowerday said lie was engaged on the line between the dam and the quarry. The jigger, which ran from Huia to near the construction camp, was used daily by men living at Huia, and others like himself, to return to work after week-ending at Huia. He said he was on his way to work when the accident occurred 12 miles from Huia. Decision was reserved.
