“GHASTLY FARCE”
DISMISSED YOUTH WINS APPEAL CANNOT RETURN TO WORK From Our Own Correspondent HAMILTON, Today. An appeal against his dismissal by Ernest Pryce Smith, electrician, Tauranga, w-as made before Mr. Justice Frazer in the Arbitration Court today by an apprentice, Leslie Hilton Carmichael, and was allowed. Evidence disclosed that the youth w-as given leave of absence to assist his father ow-ing to a mishap. He arrived late for work on the day he w-as expected back and was dismissed by Smith. In allowing the appeal, the judge described the proceedings as a ghastly farce. It was known that the employer would not take the youth back and the court could not force him to, and proceedings would not necessarily assist a civil action for damages.
