Petone. and Madelina Liez. his wife in res plot her separate estate. Plaintiff alleged that he \v;u injur >J by being knocked down by Mr. Lie/.s car, which Mrs. Liez was driving. Negligence is alleged in that Mrs. Liez failed to keep a proper lookout or exercise proper care, and also that she was not competent to drive, inn - much as she did not possess a drive:- s licence. The defence denies negligence and alleges contributory negligence in plaintiff riding a bicycle on the xx rong side of the road and failing to keep a proper lookout. and turning the bicycle into the side of the car.
